No punishment for the instigators of Mariposa botnet

According to one of the people responsible for exposing and shutting down Mariposa, the criminals behind the botnet may not receive the suitable penalty for the crimes that they have committed.
Mariposa botnet was taken down in the month of December of the year 2009. Various people worked hand-in-hand in order to make this move possible and they include the Spanish Guardia Civil, FBI, the technical director of the Panda Security Luis Corrons, and other organizations. And, just about three months after this momentous event, it was reported that the three people linked with Mariposa botnet were taken into custody.
Stealing has been made more obscure
The said botnet was created in such a way that it can steal the confidential data from the accounts registered in social networks and other e-mails services. Other pieces of information that can be seized by the Mariposa are the following: usernames and passwords of accounts, credit card information, and banking documents. And during its activity, it had been able to penetrate about 12.7 million affected IP addresses located in over 190 countries and more.
Inconsistencies in law were found
But then, Luis Corrons did not think that the alleged men plus another two, who have the online aliases “Netkairo” and “Ostiator”, will receive any sentences for their crimes. One big reason for this is that running a botnet has not yet been recognized as a crime in the country of Spain.
To elaborate, Corrons said that there is a need for the authorities to establish the fact that these men actually stole confidential data with the use of these botnet. Also, they must also point out that they utilized the stolen information in order to generate money.
Either of the two groups will have restful days
The investigation may take longer than expected and as said by the authority, they do believe that these men will not be easily locked in prison. In reality, the movement of this case may appear aggravating for both parties.
It is true that the law enforcers in Spain are doing their best in order to increase the coverage of the law in their locale. However, this action has been verified to be long overdue that it can no longer be used in the prosecution of the instigators of the Mariposa botnet.
